The Political Process in Search of a Judge: The Case of the Reluctant Italian Constitutional Court

Abstract

The article shows that the Italian Constitutional Court’s control function in the political process has so far been sketched out and applied in some areas, but not fully realised. The Court’s reluctance to assume the role of an „arbiter of the political process“ is partly explained by a desire not to be perceived as a political actor. And yet, in an alarming context of a permanent crisis of confidence in representative institutions, constitutional judges should give serious thought to how they can contribute to safeguarding the credibility of the democratic process.

Der Beitrag zeigt auf, dass die Kontrollfunktion des italienischen Verfassungsgerichts im politischen Prozess bisher nur angedeutet und in einigen Bereichen angewandt, aber nicht vollständig umgesetzt wurde. Das Zögern des Gerichtshofs, die Rolle eines „Schiedsrichters des politischen Prozesses“ zu übernehmen, erklärt sich zum Teil aus dem Wunsch, nicht als politischer Akteur wahrgenommen zu werden. Dennoch sollten die Verfassungsrichter in einem alarmierenden Kontext einer permanenten Vertrauenskrise in die repräsentativen Institutionen ernsthaft darüber nachdenken, wie sie dazu beitragen können, die Glaubwürdigkeit des demokratischen Prozesses zu sichern.
